The challenge
Claimed interests in an estate had to be examined against historical instruments, succession records and proceedings involving other parties. The immediate task was to establish the basis on which affected persons could participate and place their objections before the appropriate forum.
The execution of an instrument, authority to act, its presentation for registration and the effect of subsequent events are separate questions. The analysis required the actual chronology and governing legal principles.
A person asserting an interest may first need to establish standing and seek impleadment or another procedural route before the underlying title or instrument can be considered.
